On Thursday 11 October Tunbridge Wells Borough Council was granted an Injunction Order by the High Court in relation to a plot of rural land at Hatchintan, Grandshore Lane, Frittenden, which has been used as by the owners as a residential address for a number of years.
The Order prevents the owners, Mr Alfred Brazil and family, from carrying out any further development at the address in breach of planning control and requires the owners to stop using the land as a residential caravan site. In addition the Order requires the owners to remove mobile homes from the site and to demolish shed and utility buildings by August 2013.
Councillor Alan McDermott, Cabinet member with responsibility for Planning said: ‘After many years deliberation we welcome the High Court decision.’
Should the Injunction Order be broken the owners will be in contempt of court and could face a prison term, a fine or have assets seized.
